These Terms of Service (“Terms”) govern your use of the website atlaswastemanagement.com and the junk removal and hauling services provided by Atlas Waste Management LLC (“Atlas,” “we,” “us,” or “our”). By requesting a quote, booking a service, or using our website, you agree to these Terms.
Services Provided
Atlas provides junk removal, hauling, and related services in the Atlanta metropolitan area. Services are performed by independent contractors (“Operators”) who are licensed, insured, and authorized to perform work on behalf of Atlas.
Atlas reserves the right to refuse or cancel any service at our discretion, including for reasons of safety, legal compliance, or operational capacity.
Quotes and Pricing
Quotes are provided based on photos, descriptions, and other information you provide. Quotes are estimates and may be adjusted on-site based on the actual volume, type, or accessibility of items.
If the scope of work exceeds the original quote, the Operator will contact you for approval of a revised price before beginning work. Work will not proceed at a revised price without your consent.
All prices are in US dollars. Payment is due upon completion of the service unless otherwise agreed. Commercial customers may qualify for net-15 billing by separate agreement.
Surcharges may apply for premium items including but not limited to: mattresses and box springs, refrigerant-containing appliances, pianos, tires, electronics, and construction debris. Applicable surcharges will be disclosed before work begins.
Payment
Atlas accepts payment via credit card, debit card, and bank transfer processed through Stripe. A valid payment method must be provided at the time of booking.
Payment is due upon completion of the service. Declined payments or non-payment may result in additional collection fees and interest charges as permitted by law.
Refunds are handled on a case-by-case basis. Atlas offers a satisfaction guarantee: if you are not satisfied with our service, contact us within 24 hours of completion and we will work to resolve the issue.
Scheduling and Arrival
Atlas provides two-hour arrival windows for most scheduled jobs. We will make reasonable efforts to arrive within the scheduled window but cannot guarantee exact arrival times due to traffic, previous job duration, weather, or other factors beyond our control.
If we anticipate being more than 30 minutes late to a scheduled window, we will notify you by text or phone.
Customer Responsibilities
You agree to:
- Provide accurate information about items to be removed and the service location
- Ensure items are accessible to our crew on the scheduled service date
- Ensure you have the legal right to dispose of all items on the premises
- Not place our crew in unsafe conditions or require them to perform work outside the scope of the quote
- Be present at the service location or designate a representative who is present
- Identify any hazardous materials before work begins (see below)
Items We Will Not Remove
For safety and legal reasons, Atlas does not remove:
- Hazardous waste, including asbestos, lead-based paints, chemicals, solvents, pesticides, medical waste, biohazards, or explosives
- Items contaminated with bodily fluids or infectious substances
- Live ammunition or firearms
- Pets or animal remains
- Items containing confidential or sensitive information that has not been properly secured or destroyed by the customer
Atlas reserves the right to refuse any items at the time of service without refund obligation if those items fall into prohibited categories or create unsafe working conditions.
Property Damage
Our Operators exercise reasonable care during all jobs. In the event of accidental property damage caused by an Operator during a job, Atlas and its Operators maintain general liability insurance to cover such claims.
To report damage, contact Atlas within 48 hours of service completion. Claims must include documentation such as photographs. Atlas will investigate and respond to claims in good faith. Atlas’s total liability for any damage claim is limited to the lesser of the actual repair cost or $10,000 per incident.
Atlas is not responsible for pre-existing damage, damage resulting from customer negligence or inaccurate information, or damage caused by items or conditions the customer failed to disclose.
Items Left on Site
Customers are responsible for identifying all items to be removed. Any items not clearly indicated as “junk” will be left at the property. Atlas is not responsible for items mistakenly left behind or inadvertently removed, except in cases of clear Operator error.
Once items are loaded onto our truck, they become the property of Atlas and may be disposed of, donated, or recycled at our discretion. Customers cannot reclaim items once loaded.
Independent Contractor Relationship
Services are performed by independent contractor Operators who carry their own commercial auto insurance and general liability insurance. Operators are not employees or agents of Atlas for purposes other than performing services booked through Atlas.
Atlas dispatches, pays, and maintains the customer relationship with all Operators. Operators are contractually prohibited from soliciting Atlas customers for direct work.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY.
ATLAS’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ATLAS FOR THE SERVICE GIVING RISE TO THE CLAIM, OR (B) $10,000.
Indemnification
You agree to indemnify and hold harmless Atlas, its Operators, employees, and affiliates from any claims, damages, or expenses arising from your breach of these Terms, your misrepresentation of items to be removed, or your failure to comply with applicable laws.
Website Use
Our website is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access or error-free operation. You agree not to misuse the website, including attempting to access unauthorized areas or disrupting site functionality.
Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Fulton County, Georgia.
Before filing any legal action, you agree to contact Atlas in writing to attempt good-faith resolution of the dispute.
Changes to These Terms
Atlas may update these Terms at any time. Changes will be reflected by an updated “Last Updated” date at the top of this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
